Courts Handling Traffic Cases

Ellis County has four JP precincts that handle traffic violations on county roads and state highways. Each precinct covers a different part of the county. Your citation will list the precinct court where you need to appear or pay. If it's not clear, call the county clerk at (972) 825-5090 to find out which court has your case.

Cities in Ellis County have their own municipal courts. Waxahachie Municipal Court handles city citations within Waxahachie. Ennis and Midlothian have their own municipal courts too. If your ticket was issued by a city officer within city limits, it's a municipal court case, not a JP court case.

Paying Your Fine

Each court in Ellis County sets its own payment process. JP courts typically accept cash, check, or money order in person. Municipal courts may also accept online payments or credit cards. Call the specific court for details before driving in.

Under Article 27.14(c) of the Texas Code of Criminal Procedure, paying a traffic fine is a guilty plea. That conviction goes on your driving record through Texas DPS. If keeping a clean record matters to you, ask about deferred disposition or defensive driving before you pay.

Missing a court date or failing to pay triggers the OMNI program under Transportation Code Chapter 706. This blocks your license renewal and adds a $10 fee (or $30 for older cases). Check for holds at texasfailuretoappear.com.

Deferred Disposition

Deferred disposition under Article 45.051 lets the court hold your case for a set time, usually 90 days, while you stay out of trouble. If you do, it gets dismissed. You need to ask before your court date. A fee applies, and the judge decides whether to approve it.

This is available in both JP and municipal courts in Ellis County, but each judge handles it differently. Some courts are more willing to grant it for first offenses on less serious violations. It never hurts to ask.

Defensive Driving Course Option

Article 45.0511 of the Texas Code of Criminal Procedure allows ticket dismissal if you complete a state-approved defensive driving course. Requirements: request it before your court date, not have used DSC in the past 12 months, no CDL, not going 25+ mph over the limit. You'll need a Type 3A driving record from Texas DPS, which costs $12. Approved courses are licensed by the Texas Department of Licensing and Regulation.

Your driving record is with Texas DPS. Order it at dps.texas.gov or mail Form DR-1 to Texas DPS, P.O. Box 149008, Austin, TX 78714-9008. Type 1 record costs $4.50, Type 2 is $6.50, and Type 3A (certified) is $12. Texas doesn't use a point system anymore, but four violations in 12 months or seven in 24 months still puts your license at risk.
