JP Courts and What They Handle

Cooke County's four Justice of the Peace precincts cover different parts of the county. Your citation lists the precinct number. That tells you exactly where to go or call. The JP courts handle all Class C misdemeanor traffic offenses from county law enforcement and DPS troopers.

On I-35 through Cooke County, speeding is the most common stop. Troopers also write tickets for following too close, unsafe lane changes, and failure to move over for emergency vehicles. All of those go to a JP precinct, not municipal court, if the officer was a county deputy or state trooper.

Paying a Cooke County Ticket

Payment options vary by JP precinct in Cooke County. Some accept online or phone payments. Others prefer in-person or mail. When you call the court, ask specifically how to pay and what the total amount is. Court costs are added on top of the base fine, so the total is often higher than what the ticket shows.

Article 27.14(c) of the Code of Criminal Procedure makes clear that paying a traffic ticket in Texas is a guilty plea. The conviction goes on your DPS driving record. Before you pay, it's worth asking the court about deferred disposition as an alternative. You might pay more upfront in fees, but you avoid the conviction on your record.

Note: If you're passing through Cooke County from out of state, you still have to deal with the Texas court. An unpaid ticket can lead to a hold on your Texas driving privileges, which can affect your home state license through interstate compacts.

Deferred Disposition

Deferred disposition under Article 45.051 of the Texas Code of Criminal Procedure lets you avoid a traffic conviction without going to trial. You request it from the court, the judge approves it, and your case is put on hold for up to 180 days. During that time, stay out of trouble and meet any conditions the judge sets. At the end of the deferral period, the case is dismissed. No conviction, no record hit.

The conditions are usually simple. Pay court costs. Don't get another ticket. Some judges add defensive driving as a condition. Ask the court what they require before you commit to it. Even if deferred costs a bit more than just paying, the long-term benefit to your driving record is usually worth it.

Defensive Driving Option

Defensive driving dismissal under Article 45.0511 is available for many Class C traffic violations. You request it from the court before your court date. If approved, you complete a TDLR-licensed course and submit proof. The ticket gets dismissed.

You can use this option once every 12 months. It's not available for all violations. Commercial drivers face different rules. The judge makes the final call on whether you qualify. Get approved provider information at tdlr.texas.gov.

License Renewal Blocks and OMNI

Missing a court date or not paying on time can trigger an OMNI hold on your Texas driver's license. Once flagged, you can't renew until you clear both the ticket and the OMNI fee. Check your status at texasfailuretoappear.com. The reinstatement fee is $10 for 2020 or later cases, $30 for older ones. You have to handle both the court case and the OMNI fee to get the block lifted.
