How Traffic Citations Are Handled in Brooks County

Brooks County has two JP precincts. Each one covers a section of the county and handles citations from within that area. U.S. 281 runs north-south through Falfurrias and is the main corridor for both local travel and through-traffic between the Rio Grande Valley and San Antonio. State troopers work this stretch regularly, and the county sheriff also patrols county roads.

Falfurrias Municipal Court handles tickets issued within city limits by Falfurrias Police. Citations from state troopers and county officers outside city limits go to a JP court. Your citation names the court where you must respond and the deadline to do so.

All traffic tickets in Texas are Class C misdemeanors. They result in fines and court costs but not jail. If you pay without appearing in court, Texas law treats that as a guilty plea under Art. 27.14(c) of the Code of Criminal Procedure, and the conviction is reported to DPS. What a Traffic Ticket Record Contains

Resolving a Brooks County Traffic Ticket

Deferred disposition under Art. 45.051 of the Code of Criminal Procedure lets the court pause your case for 90 to 180 days. Meet all conditions during that time, including staying citation-free, and the case is dismissed. You usually pay a fee as part of the agreement. The Driving Safety Course (DSC) under Art. 45.0511 is another option. Complete a state-approved course and submit the certificate to the court. The ticket is then dismissed. Requirements: ask before your court date, hold a valid non-CDL license, not have used DSC in Texas in the past 12 months, and not be charged with speeding more than 25 mph over the limit. You also need a Type 3A certified driving record from Texas DPS, which costs $12 online.

Texas DPS Driver Records

The Texas Department of Public Safety tracks your driving history. Courts report convictions after cases close. You can order your record online or by mail. A Type 2 covers three years at $6.50 online. Type 3 covers full history at $7.50. Type 3A certified is $12 online or $10 by mail. That last one is required for DSC court dismissal. Mail requests go to Texas DPS, P.O. Box 149008, Austin, TX 78714-9008.

Note: Texas stopped using a driver point system in 2019. License suspension reviews now happen when a driver gets four or more moving violations in 12 months or seven or more in 24 months.

If You Don't Pay Your Ticket

Letting a Brooks County ticket go unpaid means the court will issue an arrest warrant. Texas also uses the OMNI program under Transportation Code Chapter 706. Courts report unpaid fines to DPS, which blocks your license renewal. A $10 OMNI fee is added for cases after 2020, or $30 for older cases.

If you received your ticket while passing through Brooks County and now live elsewhere, the OMNI hold still applies to your ability to renew your Texas license or any state that checks the national database.
