Payment Options

Defensive Driving Dismissal

Under Art. 45.0511 of the Code of Criminal Procedure, the Edinburg Municipal Court can dismiss your ticket if you complete an approved defensive driving course. You must request this option before your court date. Waiting until after you appear and enter a plea removes this option in most situations.

To be eligible, you must not have taken a defensive driving course to dismiss a ticket in the 12 months before this citation. CDL holders who were driving a commercial vehicle at the time of the citation cannot use this option. Some offense types, including those involving accidents with serious injuries, are also excluded by statute. If the judge approves, you get a set timeframe, usually 90 days, to complete an approved course and return the certificate to the court.

DPS records this as a Type 3A dismissal rather than a conviction. No conviction means no DPS points and no insurance rate hike from that ticket.

Deferred Disposition

Art. 45.051 of the Code of Criminal Procedure allows courts to place a traffic case on hold for a probation period, usually 90 to 180 days. If you meet the judge's conditions during that time and receive no new violations, the court dismisses the case. Deferred disposition leaves no conviction on your record.

This option can apply even when defensive driving is not available, such as when you have already used it in the past 12 months. The judge decides whether to grant it and sets the conditions. Common conditions are completing a defensive driving course, paying a deferred fee, or maintaining a clean record during the deferral period.
